WEBSITE DESIGN, HOSTING, LEASING & MANAGEMENT TERMS OF SERVICE

These Terms of Service ("Terms") govern website design, development, leasing, hosting, maintenance, management, content updates, and related services provided by Bayou Bytes Gulf Coast LLC ("Bayou Bytes," "we," "us," or "our") to the client ("Client," "you," or "your").

These Terms apply together with any accepted proposal, project scope, order summary, invoice, Stripe checkout, recurring-payment authorization, service selection, or other written agreement between Bayou Bytes and the Client.

If a signed project agreement or transaction-specific order, proposal, or service agreement directly conflicts with these general Terms, the transaction-specific agreement controls for that transaction.

By purchasing services, signing an agreement, approving a proposal, authorizing recurring billing, or otherwise accepting an order that incorporates these Terms, the Client agrees to these Terms.

1. SERVICES

Bayou Bytes designs, develops, hosts, leases, and manages professional static websites primarily for businesses.

Websites are generally created using HTML, CSS, JavaScript, optimized images, and related static-web technologies.

Services may include:

Website design and development
Responsive and mobile-friendly layouts
Business websites
Portfolio websites
Image galleries and sub-galleries
Contact forms
Click-to-call links
Maps and business information
Basic on-page search-engine optimization
Image optimization
SSL/HTTPS
Domain and DNS configuration assistance
Hosting and deployment
Automated uptime monitoring
Routine technical maintenance
Google Search Console setup
Sitemap submission
Search-engine indexing requests
Content updates under eligible service plans
Other services expressly included in a Client's order

The exact services included in a particular project are determined by the applicable proposal, project scope, order summary, checkout, or service plan.

2. STATIC-WEBSITE SCOPE

Unless specifically agreed otherwise in writing, Bayou Bytes provides static informational and portfolio websites.

Standard services do not include:

E-commerce shopping carts
Customer account systems
Database-driven applications
Custom server-side applications
Complex booking systems
Membership systems
HIPAA-regulated information systems
Storage of sensitive medical or financial information
Custom software applications
Substantial backend functionality
Other systems outside the agreed static-site scope

Bayou Bytes may link or integrate a static website with an existing third-party booking, payment, social-media, e-commerce, scheduling, review, or other external service where technically appropriate.

Functionality outside the agreed scope must be separately quoted and approved before billable work begins.

3. WEBSITE PURCHASE AND OWNERSHIP

When the Client purchases a website under an ownership option, ownership of the completed Client-specific website files transfers to the Client after:

The agreed purchase price and all approved additional charges have been paid in full; and
The website has been completed and approved for launch.

Client ownership generally includes the final Client-specific HTML, CSS, runtime JavaScript, processed Client images, and other transferable files reasonably necessary to operate the completed static website.

Client ownership does not include Bayou Bytes':

Reusable tools
General templates
Internal design systems
Automation scripts
Image-processing systems
Development workflows
General-purpose components
Reusable code libraries
Business methods
Proprietary processes
Third-party materials that cannot legally be transferred

Purchasing a website does not require the Client to continue using Bayou Bytes for hosting or management unless a separate commitment is specifically agreed in writing.

After final payment and ownership transfer, monthly Bayou Bytes management is optional.

If the Client chooses not to continue Bayou Bytes hosting or management, the Client may request transferable Client-owned website files after all properly due amounts have been paid.

The Client is responsible for replacement hosting, deployment, forms, DNS, monitoring, maintenance, and other technical services after leaving Bayou Bytes.

4. WEBSITE LEASING

Bayou Bytes may provide websites through a monthly website lease.

A website lease is not financing, installment purchasing, or rent-to-own.

Bayou Bytes retains ownership of leased website files.

While an eligible lease remains active and paid, the Client receives a limited right to use the leased website for the Client's business.

Unless otherwise agreed in writing:

Bayou Bytes retains ownership of the leased website
Monthly lease payments create no ownership equity
Lease payments do not accumulate toward a purchase price
Previous lease payments are not credited toward a later purchase
Website ownership transfers only through a separate purchase transaction
The Client's right to use the leased website ends when the lease ends

If the Client later wishes to purchase a leased website, the purchase price will be the then-current listed purchase price for the applicable website package, unless another price is agreed in writing.

After purchasing the website, the Client may select an ownership-based Bayou Bytes management plan or move the website to another compatible provider.

5. INITIAL LEASE COMMITMENT

Unless otherwise stated in the transaction-specific agreement, Business Site Lease and Portfolio Site Lease customers agree to a 12 month commitment.

The first lease payment is due before development begins.

The remaining required payments are billed monthly according to the billing schedule disclosed at enrollment.

After the 12 month commitment has been satisfied, the lease automatically continues month-to-month until canceled.

A Client may request cancellation during the initial commitment period. Such cancellation will prevent renewal beyond the initial commitment but does not eliminate amounts properly due under the agreed 12 month commitment unless:

Bayou Bytes agrees otherwise in writing; or
Applicable law requires otherwise.

After the initial commitment has been satisfied, the Client may cancel the lease before the next billing period to prevent future monthly renewals.

6. CURRENT WEBSITE PURCHASE PRICING

Current standard website purchase offerings are:

Business Website - $499 one-time

Includes:

Up to 5 standard pages
Up to 30 Client-supplied images
Mobile-responsive design
Static website development
Contact functionality where included in scope
Foundational SEO setup
Page titles and metadata
Sitemap configuration
robots.txt configuration
Google Search Console setup
Sitemap submission
Indexing requests for key launch pages
Two initial revision rounds

Standard Portfolio Website - $999 one-time

Includes up to 150 Client-supplied images, together with the applicable portfolio design and launch services stated in the project scope.

Large Portfolio Website - $1,499 one-time

Includes up to 400 Client-supplied images, together with the applicable portfolio design and launch services stated in the project scope.

Additional pages, features, image capacity, content preparation, or custom services may be quoted separately.

7. CURRENT MONTHLY SERVICE PLANS

Current standard ownership-based service plans are:

Website Care - $59/month

Includes:

Static website hosting
SSL/HTTPS
Deployment management
Automated uptime monitoring
Routine technical maintenance
Basic operational support

Website Care does not include Client-requested content updates.

Essentials - $99/month

Includes all standard Website Care services plus:

One bundled routine content-update request per monthly billing period

A bundled update may contain a reasonable group of related routine changes to existing website content.

Unused monthly bundled updates do not accumulate or roll over into future months unless otherwise agreed in writing.

Hands-Free Unlimited - $149/month

Includes standard hosting and management services plus:

Unlimited reasonable routine updates to existing website content, subject to the Fair Use Policy in these Terms.

"Unlimited" applies only to eligible routine updates and does not include unlimited development labor.

8. CURRENT WEBSITE LEASE PRICING

Current standard lease offerings are:

Business Site Lease - $139/month

Includes:

Use of a Bayou Bytes-owned business website during the active lease
Hosting
SSL/HTTPS
Deployment management
Automated uptime monitoring
Routine technical maintenance
One bundled routine content-update request per monthly billing period

Unless otherwise stated in the order, the standard Business Site Lease is based on the general scope of the standard Business Website package.

Portfolio Site Lease - $199/month

Includes:

Use of a Bayou Bytes-owned portfolio website during the active lease
Hosting
SSL/HTTPS
Deployment management
Automated uptime monitoring
Routine technical maintenance
Unlimited reasonable routine text and existing-content edits under Fair Use
Portfolio-image additions subject to the image-update limits in these Terms

The initial image capacity and gallery structure of a leased portfolio website will be identified in the applicable order or project scope.

9. PRICES, TAXES, AND FUTURE PRICING

Current pricing may be displayed on the Bayou Bytes website, proposal, quote, order summary, invoice, or checkout.

The transaction-specific price accepted by the Client controls that transaction.

Unless expressly stated otherwise, published and quoted prices do not include applicable sales, use, or similar taxes.

Bayou Bytes will collect applicable taxes when required by law.

Bayou Bytes may change prices, packages, or services offered to:

Future customers
New projects
Future renewal periods

A pricing change does not retroactively change a fully paid website purchase or completed billing period.

Existing recurring Clients will receive notice of material price changes when required by applicable law or the applicable agreement.

10. PURCHASED WEBSITE BUILD PAYMENTS

Unless another payment arrangement is stated in writing, website purchase projects require:

50% non-refundable project deposit before work begins
50% remaining balance before final launch or transfer

The deposit reserves production capacity and compensates Bayou Bytes for project setup, planning, design, development, and work performed.

Additional work outside the agreed project scope is separately billable only after the additional scope and price have been disclosed and approved.

11. RECURRING BILLING AUTHORIZATION

When the Client enrolls in a monthly service or website lease, the Client authorizes recurring charges according to the price and billing interval disclosed before enrollment.

Bayou Bytes will disclose material recurring-service terms before charging the Client.

Recurring services continue until canceled in accordance with these Terms and any applicable minimum commitment.

The Client may cancel eligible future recurring charges using the cancellation method made available by Bayou Bytes or by contacting Bayou Bytes using an authorized contact method.

Cancellation of an ordinary month-to-month management plan prevents renewal after the current paid billing period.

Cancellation of a website lease remains subject to the initial lease commitment described in Section 5.

Mandatory cancellation, renewal, notice, consent, and refund rights provided by applicable law remain unaffected.

12. HOSTING AND WEBSITE MANAGEMENT

Hosting and management services may include:

Static website hosting
SSL/HTTPS management
Deployment management
Automated uptime monitoring
Routine technical maintenance
Website-health checks
Basic operational support
Services specifically included in the selected plan

Bayou Bytes does not guarantee uninterrupted operation of the Internet, hosting platforms, DNS systems, domain registries, form-processing providers, telecommunications systems, or other third-party infrastructure.

Bayou Bytes will make commercially reasonable efforts to maintain websites under active service.

13. ROUTINE CONTENT UPDATES

Routine content updates are reasonable changes to existing website content.

Examples may include:

Text
Business hours
Phone numbers
Addresses
Existing services
Existing pricing
Staff information
Photographs
Portfolio images
Gallery content
Promotional messages
Comparable changes to existing content

Routine updates do not ordinarily include new pages, major redesigns, new applications, major structural changes, or new custom functionality.

Clients should submit update requests in organized batches whenever reasonably practical.

14. PORTFOLIO IMAGE UPDATES

For Portfolio Site Lease plans, new portfolio images may be submitted in up to two scheduled batches per monthly billing period.

Each batch may contain a maximum of 50 Client-supplied images.

Images must be reasonably organized and identified.

Large-scale gallery restructuring, excessive image preparation, substantial editing, or requests beyond these limits may be separately quoted.

Unused image batches do not accumulate or roll over unless Bayou Bytes agrees otherwise in writing.

15. FAIR USE - UNLIMITED UPDATE PLANS

A plan described as providing "unlimited updates" means unlimited reasonable routine updates to existing website content, subject to this Fair Use Policy.

"Unlimited" does not mean unlimited development labor, unlimited redesign work, or unlimited expansion of the website.

Unlimited updates ordinarily do not include:

New websites
Major redesigns
Complete page redesigns
New custom functionality
New applications
Major structural changes
Complex integrations
Large-scale copywriting
Extensive research
Extensive image or video editing
Substantial new sections
New pages beyond the existing scope
Major gallery restructuring
Rebuilding substantial portions of the website
Work outside the Client's existing website structure

Bayou Bytes may require Clients to combine excessive small requests into organized batches.

Work outside Fair Use will be identified before it becomes billable.

Bayou Bytes will obtain Client approval before beginning separately billed additional work.

16. ADDITIONAL AND OUT-OF-SCOPE WORK

Work outside the originally agreed project or service-plan scope is not included in standard website pricing or recurring service fees.

Examples include:

Major redesigns
New pages
Substantial new sections
New functionality
Major gallery restructuring
Complex third-party integrations
Extensive content preparation
Extensive copywriting
Research
Significant image or media processing
Custom development
Other substantial work beyond the agreed scope

Additional work is currently quoted at $100/hour or as a fixed project price.

Bayou Bytes will disclose and obtain approval of the price before beginning additional billable work.

Bayou Bytes is not required to disclose internal labor calculations, proprietary pricing formulas, development methods, or estimated internal production costs for fixed-price work.

17. INITIAL REVISIONS

Unless otherwise stated in writing, a newly built website - whether purchased or leased - includes two reasonable initial revision rounds before launch.

A revision round consists of an organized group of reasonable changes to the agreed design and content.

Initial revision rounds do not include:

Complete redesigns
Significant changes in project direction
Substantial additions to the original scope
New functionality
Rebuilding previously approved portions of the website
Work beyond the purchased or leased package

Additional revision work may be quoted separately.

18. CLIENT CONTENT AND RESPONSIBILITIES

The Client is responsible for providing information and materials reasonably necessary to complete the website.

This may include:

Business name
Contact information
Service descriptions
Business hours
Pricing
Logos
Photographs
Portfolio images
Staff information
Other website content

The Client represents that the Client owns or has permission to use materials supplied to Bayou Bytes.

The Client is responsible for obtaining any necessary:

Copyright licenses
Photographer permissions
Model releases
Trademark permissions
Property releases
Privacy permissions
Publicity permissions
Other rights or authorizations

Bayou Bytes may refuse, disable, or remove material reasonably believed to be unlawful, infringing, fraudulent, defamatory, harmful, or otherwise inappropriate for publication.

19. IMAGE AND PORTFOLIO CONTENT

Clients providing substantial quantities of images must supply them in a reasonably organized format.

Current purchased portfolio limits are:

Standard Portfolio: up to 150 Client-supplied images
Large Portfolio: up to 400 Client-supplied images

Images should be grouped or labeled by project, artist, service, category, or another agreed organizational system where applicable.

Unless separately agreed, Bayou Bytes is not responsible for:

Determining which unidentified project an image belongs to
Identifying unknown artists or subjects
Extensive photo retouching
Reconstructing disorganized media libraries
Writing descriptions for large quantities of images
Determining whether the Client possesses legal rights to supplied material

Additional organization or media-preparation work may be quoted separately.

20. CLIENT REVIEW AND APPROVAL

The Client is responsible for reviewing the website before final launch approval.

The Client should verify:

Business names
Addresses
Phone numbers
Email addresses
Business hours
Prices
Services
Spelling
Photographs
Links
Legal notices
Client-specific information

Bayou Bytes is not responsible for losses arising from Client-approved inaccurate information except where applicable law provides otherwise.

21. DOMAIN NAMES

Whenever practical, a Client purchasing a website should own or control the domain used for the Client's business.

Bayou Bytes may assist with domain configuration or management.

Domain-registration fees, premium-domain costs, renewals, transfers, registrar fees, and other domain expenses may be separate from Bayou Bytes pricing unless expressly included in writing.

The Client is responsible for maintaining accurate registration information and complying with registrar requirements.

22. THIRD-PARTY SERVICES

Websites may rely on third-party providers, including:

Hosting infrastructure
DNS providers
Domain registrars
Email providers
Analytics providers
Mapping services
Payment services
Form-processing systems
Search engines
Social-media platforms
Booking systems
Other outside services

Bayou Bytes does not control third parties.

Changes, outages, discontinued services, pricing changes, policy changes, security incidents, or failures affecting third parties may affect a Client's website.

Bayou Bytes will make reasonable efforts to address issues within its control but does not guarantee third-party performance or availability.

23. SEARCH ENGINES AND GOOGLE SETUP

Bayou Bytes may perform foundational search-engine optimization and launch work.

This may include:

Appropriate page titles
Headings
Metadata
Image optimization
Alternative text
Structured content
Internal links
Sitemap configuration
robots.txt configuration
Google Search Console setup
Sitemap submission
Requests that Google index important launch pages

Submission to a search engine does not guarantee indexing, ranking, or placement.

Bayou Bytes does not control search-engine algorithms.

24. MARKETING AND BUSINESS RESULTS

Bayou Bytes does not guarantee:

Search-engine rankings
First-page placement
Google Business Profile rankings
Website traffic
Leads
Customer inquiries
Sales
Revenue
Conversion rates
Any particular business result

Search algorithms, competitors, market conditions, customer behavior, advertising, pricing, reputation, demand, and other outside factors may affect results.

25. LEGAL AND REGULATORY COMPLIANCE

The Client is responsible for identifying legal and regulatory requirements applicable to the Client's business, industry, products, services, and website.

This may include requirements concerning:

Business licensing
Professional licensing
Advertising
Consumer disclosures
Privacy
Data collection
Accessibility
Industry-specific regulations
Terms and policies
Intellectual property
Other legal obligations

Bayou Bytes is a website-design and management provider and does not provide legal, accounting, tax, or regulatory advice.

Unless specifically agreed in writing, Bayou Bytes does not guarantee that a website complies with any particular statute, regulation, industry standard, accessibility standard, privacy law, or professional rule.

Bayou Bytes may place Client-provided policies, notices, disclosures, accessibility content, or other compliance materials on a website within the agreed scope.

Clients needing legal or regulatory advice should consult an appropriately qualified professional.

26. ACCESSIBILITY

Bayou Bytes may use reasonable web-development practices intended to improve general usability and accessibility.

Unless a specific accessibility audit or compliance engagement is included in writing, Bayou Bytes does not warrant or certify compliance with a specific accessibility standard, including any particular version or level of WCAG or another accessibility framework.

The Client remains responsible for determining whether specific accessibility obligations apply to the Client's business.

27. FORMS, DATA, AND PRIVACY

Static websites may use third-party form-processing, analytics, hosting, mapping, email, or similar services.

Bayou Bytes does not ordinarily provide custom systems intended to store sensitive medical, financial, authentication, or similarly sensitive information.

Clients should not request that Bayou Bytes static contact forms collect sensitive information unless an appropriate solution has been separately reviewed and agreed.

The Client is responsible for determining whether a privacy policy, cookie notice, consent mechanism, or other privacy disclosure is legally required for the Client's business.

28. ACCOUNT CREDENTIALS AND SECURITY

The Client may be required to provide or authorize temporary access to domains, DNS, hosting, Search Console, analytics, or other services necessary to perform agreed work.

The Client is responsible for:

Maintaining control of Client-owned accounts
Using secure passwords
Protecting authentication credentials
Maintaining current recovery information
Informing Bayou Bytes when access should be changed or revoked

Bayou Bytes will use reasonable care with credentials provided for authorized work but cannot guarantee the security of third-party systems.

29. CLIENT DELAYS AND INACTIVITY

Project timelines depend on Client cooperation.

Delays in providing:

Content
Images
Approvals
Credentials
Payment
Feedback
Requested information

may delay development or launch.

Bayou Bytes is not responsible for delays caused by missing or late Client materials.

If a Client becomes substantially unresponsive, Bayou Bytes may pause the project until the Client resumes participation.

Extended delays may require rescheduling based on Bayou Bytes' then-current production availability.

30. UPDATE AND SUPPORT TURNAROUND

Bayou Bytes will make reasonable efforts to process eligible update and support requests promptly.

Unless a specific response or completion time is stated in writing, Bayou Bytes does not guarantee:

Same-day updates
Immediate changes
24-hour completion
Emergency response
Specific turnaround times

Turnaround may depend on request complexity, production workload, Client responsiveness, third-party services, and other circumstances.

Routine service requests are generally handled during Bayou Bytes' normal business operations.

31. SUSPENSION OF SERVICES

Bayou Bytes may suspend hosting, updates, development, support, or other services where reasonably necessary because of:

Failure to pay amounts properly due
Material violation of these Terms
Unlawful activity
Fraudulent or deceptive conduct
Abusive, threatening, or harassing behavior
Serious security concerns
Intentional interference with systems
Significant legal or operational risk

When reasonably practical, Bayou Bytes will provide notice and an opportunity to correct the issue before suspension.

Suspension does not waive properly due charges or automatically terminate an agreed minimum lease commitment.

32. TERMINATION

Bayou Bytes may terminate services for a material breach of these Terms, unlawful activity, fraud, persistent nonpayment, serious abuse, substantial security risk, or another material circumstance making continued service unreasonable or unlawful.

When reasonably practical, notice and an opportunity to cure will be provided.

A Client may terminate services subject to:

Applicable billing terms
Any agreed minimum commitment
Properly due amounts
These Terms

33. EFFECT OF CANCELLATION OR TERMINATION

Client-Owned Websites

Cancellation of Bayou Bytes hosting or management does not eliminate ownership already transferred to the Client.

After all properly due amounts are paid, the Client may request transferable Client-owned website files.

The Client assumes responsibility for replacement hosting, deployment, forms, domains, monitoring, maintenance, and support.

Leased Websites

The Client's right to use a leased website ends when the lease legally ends.

Bayou Bytes may disable or remove a leased website after the applicable service period ends.

Ending a lease does not transfer ownership.

Website ownership transfers only through a separate purchase transaction.

34. REFUNDS

Website project deposits are non-refundable because Bayou Bytes reserves production capacity and begins planning, setup, design, or development work after acceptance.

Recurring payments for billing periods already begun are non-refundable except where:

Bayou Bytes expressly agrees otherwise
A transaction-specific agreement provides otherwise
Applicable law requires otherwise

Amounts paid for completed work, completed service periods, domain purchases, third-party costs, or other nonrecoverable expenses are non-refundable except where required by law.

35. COPYRIGHT AND TAKEDOWN REQUESTS

Bayou Bytes respects intellectual-property rights.

A person who believes material hosted or managed by Bayou Bytes infringes intellectual-property rights may submit written notice identifying:

The disputed material
The claimed right
The location of the material
The basis for the claim
Appropriate contact information

Bayou Bytes may disable or remove disputed material while evaluating a credible claim or when reasonably necessary to reduce legal risk.

The Client remains responsible for Client-supplied materials.

36. FORCE MAJEURE

Bayou Bytes is not responsible for delays or failures caused by events reasonably beyond its control, including:

Hurricanes
Tropical storms
Flooding
Fire
Severe weather
Natural disasters
Widespread Internet failures
Utility outages
Hosting-provider outages
Telecommunications failures
Government action
Cyberattacks
Labor disruptions
War
Civil disturbance
Other comparable events outside Bayou Bytes' reasonable control

Bayou Bytes will make reasonable efforts to resume affected services when conditions permit.

37. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Bayou Bytes will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

This includes losses involving:

Lost profits
Lost revenue
Lost business opportunities
Lost prospective customers
Lost search ranking
Lost data
Business interruption
Consequential third-party losses

To the fullest extent permitted by applicable law, Bayou Bytes' aggregate liability arising from a particular project or service will not exceed the amount actually paid by the Client to Bayou Bytes for the project or applicable service giving rise to the claim.

Nothing in these Terms excludes or limits liability that legally cannot be excluded or limited.

38. INDEMNIFICATION

To the extent permitted by law, the Client agrees to defend, indemnify, and hold harmless Bayou Bytes Gulf Coast LLC and its owners, agents, and contractors from third-party claims arising from:

Client-supplied content
The Client's products or services
Materials the Client lacked authority to use
False or misleading Client-supplied information
The Client's unlawful conduct
The Client's violation of another person's rights
Client-requested publication of unlawful or infringing materials

This provision does not require indemnification for Bayou Bytes' own conduct where prohibited by law.

39. PORTFOLIO AND PROMOTIONAL USE

Bayou Bytes will not rely solely on these Terms as authorization to use a Client's business, logo, project, or website as promotional material.

Permission to:

Identify a Client
Display screenshots
Link to the Client's website
Display project images
Use a Client logo
Feature a project in the Bayou Bytes portfolio

may be obtained through separate written authorization.

Portfolio permission does not constitute a testimonial or endorsement unless separately provided by the Client.

40. CHANGES TO SERVICES OR TERMS

Bayou Bytes may update these Terms prospectively as its services, technology, business operations, or legal obligations change.

Updated Terms may apply to:

New customers
New transactions
New service selections
Future renewal periods after appropriate notice

Material changes affecting existing Clients will be communicated when required by applicable law or agreement.

Changes do not retroactively eliminate website ownership already transferred or alter a completed and fully paid service period.

41. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, except where another jurisdiction's mandatory law applies.

To the extent legally permitted, disputes concerning services provided by Bayou Bytes will be brought in a court of competent jurisdiction in Harrison County, Mississippi.

Mandatory legal rights remain unaffected.

42. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will continue in effect.

43. WAIVER

Failure by Bayou Bytes to enforce any provision on one occasion does not waive the right to enforce that provision or another provision later.

44. ASSIGNMENT

The Client may not assign or transfer an active website lease or service agreement to another person or entity without Bayou Bytes' written consent.

Proposal
Quote
Project scope
Order summary
Invoice
Service selection
Checkout authorization
Signed agreement
Written amendment

constitute the agreement concerning the applicable services.

Material modifications, new promises, additional scope, or separately quoted work should be documented in writing.

46. ELECTRONIC COMMUNICATIONS AND ACCEPTANCE

The Client agrees that contracts, approvals, notices, invoices, service selections, recurring-payment authorizations, and other business communications may be provided electronically where legally permitted.

Electronic acceptance, checkout authorization, email approval, digital signature, or another legally recognized method may constitute written acceptance.

CLIENT ACKNOWLEDGMENT

By purchasing services, signing a project agreement, approving an applicable proposal, authorizing recurring billing, or accepting an order or checkout incorporating these Terms, the Client acknowledges that the Client:

Has had an opportunity to review these Terms
Understands the selected service and pricing
Understands whether the website is purchased or leased
Understands applicable recurring-payment obligations
Accepts these Terms
